Terms of sale
These are the terms of sale ("Terms") of Dewald P. Montgomery trading as Delitech I.T. Solutions ("we, us, our").
By purchasing accessories, components, consumables, hardware, licences, parts, peripherals and/or software ("goods") from us, you agree to our terms.
We may change our terms at any time. It is your responsibility to review our terms from time to time.
You agree to our prices. All prices are subject to change without prior notice. Errors and omissions excluded.
Unless stated otherwise, our prices exclude service fees for installation, configuration etc. All services are subject to our terms of service.
We are a reseller, not a manufacturer. We do not guarantee compatibility, performance, reliability and/or quality of any goods.
Our quotes are typically valid for 14 days unless stated otherwise. We reserve the right to cancel any quote at our discretion.
Prices exclude delivery in the East Rand/Pretoria. Delivery/courier to other areas at your own cost subject to prior arrangement. Delivery to the East Rand/Pretoria occurs usually in 3-4 days subject to confirmation of stock and payment in full. We will not be held liable for delays on the part of suppliers.
You agree to the risk of damage to or theft of goods. You may insure goods by paying a non-refundable premium of 10% of the insured value. Should goods be damaged or stolen and the premium be paid in full, we will refund to you the sum insured.
We do not stock any goods at our premises (all orders are placed directly with our suppliers). We do not guarantee the availability of any stock with our suppliers.
We will not exchange/refund any accessories, consumables, software or media ("exclusions"). These goods are without warranty.
Subject to the above exclusions, we will exchange/refund in full unopened and unused goods if returned to us within 7 days of purchase. If returned between 7 and 21 days from the date of purchase, we will exchange/refund unopened and unused goods subject to a 15% restocking fee. We will not exchange/refund any goods if returned to us later than 21 days from the date of purchase unless faulty under the manufacturer’s warranty.
Subject to the above exclusions, we will exchange/repair/refund goods if faulty under the manufacturer's warranty if returned to us within the warranty period. All goods are subject to inspection for compliance with warranty terms and installation requirements by the manufacturer. It is your responsibility to check the manufacturer's warranty terms and installation requirements (see the applicable manufacturer's website).
We will not refund delivery or service fees or any insurance premiums. Refunds will be paid by EFT/internet banking only.

The listing of goods in our online catalog is not indicative of the availability of stock. Any images used to depict products are for purposes of illustration only and may not resemble the actual product. All orders must be paid for prior to delivery. All goods remain our property until paid for in full. Confirmed orders not paid for in 24 hours will be cancelled.
We accept cash, EFT/internet banking, bank guaranteed cheques, and credit cards. Cheque and EFT/internet banking payments subject to applicable clearance period (i.e. your order will be delayed). Our banking details are First National Bank (FirstRand), Cheque/Current # 62167198772 Menlyn Park branch (252645). Our banking details appear on all quotes and invoices. Credit card payments are processed by either PayFast or MonsterPay.
Promotional terms apply to special offers. We reserve the right to withdraw special offers at any time.
All goods are warranted by the manufacturer for 1 year from the date of purchase unless stated otherwise. New PC's assembled and sealed by Delitech I.T. Solutions are warranted against material defects for 3 years from the date of purchase. Flash drives are warranted for 6 months from the date of purchase. Hard drives are warranted for 5 years. Accessories, consumables, media and software are without any warranty. Data can never be guaranteed. Data loss due to hard drive failure is at your own risk and liability. It is your responsibility to backup your data regularly. Proof of authorised installation by a qualified technician / lightning/surge protection may be required in the event of warranty claims.
The manufacturer is liable for honouring its warranty. While we will make every effort to assist you, we will not be held liable under the manufacturer’s warranty. Any dispute shall be between you and the manufacturer and fees charged by the manufacturer for your account.
All warranties exclude normal wear and tear and damage due to lightning, water or power surge. It is your responsibility to install lightning/surge protection and to insure goods against any damage or loss not covered by the manufacturer’s warranty.
The following will void your warranty:
- Removal of plugs/labels
- Physical damage or abuse
- Liquid damage
- Commercial or any unintended/uninformed use
- Overclocking (memory, graphics card, processor)
- Modification or alteration
- Unauthorised service
- Improper installation and/or configuration (e.g. broken or bent pins/incompatible parts etc.)

You agree not to report to any 3rd party, consumer forum, on any website or in the media without giving us reasonable opportunity to respond. We may respond to any such reports on our website.
We will not be held liable for the claims or representations of reviewers or any third party.
In the event that we take legal action against you, all costs, including but not limited to legal fees on attorney-client basis, will be for your account. You agree to the jurisdiction of the Magistrate's Court as the final forum for dispute resolution.
ALL GOODS ARE SUPPLIED "AS IS" AND WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, OTHER THAN THE MANUFACTURER'S WARRANTY.
EXCEPT TO ANY EXTENT PROHIBITED UNDER THE LAW, YOU DISCLAIM US FROM ANY LIABILITY TO YOU FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGE OR LOSS, INCLUDING BUT NOT LIMITED TO, ANY DAMAGE OR LOSS ARISING FROM LOST PROFITS, REVENUE OR OPPORTUNITY, RELIANCE ON OUR SERVICES, PERFORMANCE, QUALITY, OR RELIABILITY OF ANY PRODUCTS, OR DAMAGE TO OR LOSS OF DATA, OR PROPERTY. YOUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT, OR OTHERWISE) WILL BE LIMITED TO R1000.
DELITECH I.T. SOLUTIONS and DELITECH and the Delitech I.T. Solutions logo are trademarks of Delitech I.T. Solutions in the Republic of South Africa. The name DELITECH I.T. SOLUTIONS is a registered defensive name.
Any failure by us to enforce any of our terms shall not be construed as a continuing waiver of any of our rights under our terms.
In the event that any of our terms are held unenforceable, the remaining terms shall remain in full force and effect.
If any claims resulting from your use of our services are made against us, you will be liable to us for all damages, costs, judgements, and/or expenses, including but not limited to legal fees.
Our terms are governed by and construed in accordance with the laws of the Republic of South Africa, as applied to agreements entered into.
Our terms constitute an agreement between the parties, and all prior or contemporaneous agreements are merged herein and superseded hereby.
ANY RIGHTS NOT EXPRESSLY GRANTED HEREIN ARE RESERVED.
