Terms of service

These are the terms of service (“terms”) of D.P. Montgomery trading as Delitech I.T. Solutions (“we, us, our”).

By ordering or receiving services from us, you agree to our terms.

We may change our terms at any time. It is your responsibility to review our terms from time to time.

You agree to our service fees. We may change our service fees at any time.

Unless stated otherwise, our service fees exclude the cost of accessories, components, consumables, hardware, licences, media, parts, peripherals and/or software ("goods"). All sales are subject to our terms of sale.

Our services are subject to availability during service hours, i.e. Mo-Fr 08:00-16:00, Sa 08:00-14:00. We are closed on Sunday, public holidays and closing dates.

You agree to provide full personal and contact details ("personal information"). We respect your privacy. Except to any extent required under the law, we will not disclose any of your personal information to any 3rd party.

Support responds to e-mail daily (excluding Christmas Day and New Year's Day) from 06:00-22:00.

Our services are typically available in the East Rand and Pretoria areas. Other areas are subject to a travelling fee of R3.90 per km. Any tollgate and parking fees will be for your account.

Our services are strictly appointment based. It is your responsibility to contact us to make an appointment.

You may cancel any appointment up to two hours prior to the scheduled start time of the appointment. If you fail to cancel an appointment, a call out and one hour's service fees will be payable. We reserve the right to cancel any appointment at any time for any reason.

A call out fee will be payable for every visit to your premises whether or not we provide any services to you. We will charge service fees as listed on our website or otherwise quoted.

You agree to provide any information, including but not limited to confidential and/or sensitive information (for example, passwords, license keys, etc.) we need to provide services to you. If you are unable or otherwise refuse to provide such information, we may not be able to provide services to you.

It is your sole responsibility to back up your data. We will not be held liable for any data loss.

While we endeavour to provide services to you as quickly as possible, we cannot commit to any timeframe for providing services to you. Depending on the situation, more than one appointment may be necessary to provide services to you.

Some services carry a risk, including but not limited to data loss. We will advise you of any risks. In the event that you agree to any risks, you disclaim us from all liability.

You may need to purchase goods during the course of some upgrades and repairs. If you purchase such goods from us, our terms of sale apply.

Should you refuse to accept our recommendations we may not be able to provide services to you. In any such event, you disclaim us from any liability and remain liable for payment of our services fees up to that point in time.

In the event of an emergency, we recommend you purchase goods from your nearest computer retailer.

Our terms apply to all service contracts.

You may not abuse our staff. If you abuse our staff, we may refuse to provide service to you.

We may publish your comments and reviews on our website or in any of our marketing materials.

You agree not to report to any 3rd party, consumer forum, on any website or in the media without giving us reasonable opportunity to respond. We may respond to any such reports on our website.

We guarantee our work for 14 days. Should the problem recur within 14 days, we may provide additional services to you in remedy free of charge and/or refund any service fees paid at our option. The cost of goods is excluded from this guarantee. Should any call out under this guarantee be invalid, you will be liable for payment of our service fees.

We accept cash, EFT/internet banking, bank guaranteed cheques, and credit cards. Cheque and EFT/internet banking payments subject to applicable clearance period (i.e. your order will be delayed). Our banking details are First National Bank (FirstRand), Cheque/Current # 62167198772 Menlyn Park branch (252645). Our banking details appear on all quotes and invoices. Credit card payments are processed by either PayFast or MonsterPay.

Unless we offer credit terms, you agree to pay for all goods and services in cash. Credit terms are subject to credit approval (you may need to provide a copy of your payslip and/or 3 months bank statements). If you fail to pay according to your credit terms, we may cancel your credit terms, in the event of which you must pay all amounts owing immediately.

Late, rejected and reversed payments are subject to an admin fee of 10%. In the event of late payment, we may reverse any discounts given.

You agree to debt collection in the event that you are 90 days in arrears. All costs will be for your account.

Promotional terms apply to special offers. We reserve the right to withdraw special offers at any time.

If you book in any of your computers, servers, software, peripherals and/or any other hardware (“property”) to our workshop, you agree that we may collect, transport and store your property. A fee to collect your property will be payable. It is your responsibility to provide an inventory of your property. While we endeavour to complete workshop services within 3 days, we offer no guarantees. Upgrades and repairs are subject to the availability of parts. We will deliver your property to you within 3 days of completing work.

You agree to the risk of damage to or theft of property. You may insure property by paying a non-refundable premium of 10% of the insured value. Should property be damaged or stolen and the premium be paid in full, we will refund to you the sum insured.

We will not be held liable for the claims or representations of reviewers or any third party.

In the event that we take legal action against you, all costs, including but not limited to legal fees, will be for your account. You agree to the jurisdiction of the Magistrate's Court as the final forum for dispute resolution.

OUR SERVICES ARE PROVIDED "AS IS" AND WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

EXCEPT TO ANY EXTENT PROHIBITED UNDER THE LAW, YOU DISCLAIM US FROM ANY LIABILITY TO YOU FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGE OR LOSS, INCLUDING BUT NOT LIMITED TO, ANY DAMAGE OR LOSS ARISING FROM LOST PROFITS, REVENUE OR OPPORTUNITY, RELIANCE ON OUR SERVICES, PERFORMANCE, QUALITY, OR RELIABILITY OF ANY PRODUCTS, OR DAMAGE TO OR LOSS OF DATA, OR PROPERTY. OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT, OR OTHERWISE) WILL BE LIMITED TO R1000.

DELITECH I.T. SOLUTIONS and DELITECH and the Delitech I.T. Solutions logo are trademarks of Delitech I.T. Solutions in the Republic of South Africa. The name DELITECH I.T. SOLUTIONS is a registered defensive name.

Any failure by us to enforce any of our terms shall not be construed as a continuing waiver of any of our rights under our terms.

In the event that any of our terms are held unenforceable, the remaining terms shall remain in full force and effect.

If any claims resulting from your use of our services are made against us, you will be liable to us for all damages, costs, judgements, and/or expenses, including but not limited to legal fees.

Our terms are governed by and construed in accordance with the laws of the Republic of South Africa, as applied to agreements entered into.

Our terms constitute an agreement between the parties, and all prior or contemporaneous agreements are merged herein and superseded hereby.

ANY RIGHTS NOT EXPRESSLY GRANTED HEREIN ARE RESERVED.
