These are the ADSL terms of service (“terms”) of Dewald P. Montgomery trading as Delitech I.T. Solutions (“we, us, our”).

By ordering or receiving internet services ("services") from us, you agree to our terms and our acceptable use policy and e-mail policy.

We may change our terms at any time. It is your responsibility to review our terms from time to time.

If you violate our terms, we may suspend our services to you. You may use our services for lawful purposes only. If you use our services for unlawful purposes, we reserve the right to terminate our services to you.

You agree to our service fees (depends on service). We may change our service fees at any time. We will notify you of changes to our fees.

Our services are subject to availability.

You agree to provide full personal/business details (including contact details). We respect your privacy. Except to any extent required under the law, we will not disclose any of your personal information to any 3rd party.

We may send you service notices by e-mail and SMS.

Support responds to e-mail daily (excluding Christmas Day and New Year's Day) from 06:00-22:00.

Our services are available to anyone in South Africa (subject to the availability of infrastructure).

You may not abuse our staff. If you abuse our staff, we may terminate all services to you.

We may publish your comments and reviews on our website.

You agree not to report to any 3rd party, consumer forum, on any website or in the media without giving us reasonable opportunity to respond. We may respond to any such reports on our website.

Performance of our services depend on a number of variables, including but not limited to connection speed, computer/network configuration, browser, firewall configuration, time of day (for example, peak-time) and actual use of our services (e.g. BrowseDSL is not suitable for online gaming). We will not be held liable for 3^rd party outages, e.g. outages on the Seacom or SAT3 cable, or any problems at your end.

Any pro-rata fees are payable in full prior to activation of any services.

Service fees are payable monthly in advance. You must pay for services no later than the 28th day of the month. In the event of late payment (subject to a five day grace period) we may suspend our services to you.

You agree to debt collection in the event that you are 90 days in arrears. All costs will be for your account.

We accept cash, EFT/internet banking, bank guaranteed cheques, and credit cards. Our banking details are First National Bank (FirstRand), Cheque/Current # 62167198772 Menlyn Park branch (252645). Our banking details appear on all quotes and invoices. Credit card payments are processed by either PayFast or MonsterPay.

Late, rejected and reversed payments are subject to an admin fee of 10%. In the event of late payment, we may reverse any discounts given.

Promotional terms apply to special offers. We reserve the right to withdraw special offers at any time.

We will not be held liable for the claims or representations of reviewers or any third party.

Several ADSL plans are allocated a monthly data allowance. If you exceed your data allowance, our services to you will be suspended until you "top-up" via your control panel.  Depending on the service, "top-up" fees will either be payable immediately (prepaid) or charged and payable during the next billing cycle. You can check usage in your control panel. (Your control panel remains accessible even after you have been capped).

A fair-use policy applies to our PowerDSL plans. Our SurfDSL plans are not suitable for streaming, downloads or gaming. All services are optimised for business purposes.

Unused data for certain services (e.g. Capped ADSL) expire at the end of the month. Roll-over options are available.

It is your responsibility to protect your computer/network from internet threats including but not limited to, viruses, worms, trojans, etc.

You may cancel our services to you by giving us 30 days’ notice. We reserve the right to terminate our services to you at any time if you violate our terms.

In the event that we take legal action against you, all costs, including but not limited to legal fees on attorney-client basis, will be for your account. You agree to the jurisdiction of the Magistrate's Court as the final forum for dispute resolution.

OUR SERVICES ARE PROVIDED "AS IS" AND WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

EXCEPT TO ANY EXTENT PROHIBITED UNDER THE LAW, YOU DISCLAIM US FROM ANY LIABILITY TO YOU FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGE OR LOSS, INCLUDING BUT NOT LIMITED TO, ANY DAMAGE OR LOSS ARISING FROM LOST PROFITS, REVENUE OR OPPORTUNITY, RELIANCE ON OUR SERVICES, PERFORMANCE, QUALITY, OR RELIABILITY OF ANY PRODUCTS, OR DAMAGE TO OR LOSS OF DATA, OR PROPERTY. OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT, OR OTHERWISE) WILL BE LIMITED TO R1000.

DELITECH I.T. SOLUTIONS and DELITECH and the Delitech I.T. Solutions logo are trademarks of Delitech I.T. Solutions in the Republic of South Africa. The name DELITECH I.T. SOLUTIONS is a registered defensive name.

Any failure by us to enforce any of our terms shall not be construed as a continuing waiver of any of our rights under our terms.

In the event that any of our terms are held unenforceable, the remaining terms shall remain in full force and effect.

If any claims resulting from your use of our services are made against us, you will be liable to us for all damages, costs, judgements, and/or expenses, including but not limited to legal fees.

Our terms are governed by and construed in accordance with the laws of the Republic of South Africa, as applied to agreements entered into.

Our terms constitute an agreement between the parties, and all prior or contemporaneous agreements are merged herein and superseded hereby.

ANY RIGHTS NOT EXPRESSLY GRANTED HEREIN ARE RESERVED.
